Legal Question in Criminal Law in California
Being detained by police, outside of my tent, I was asked if I had any weapons. I replied that there was a bb gun inside the tent. They said that they had to verify it was not a real gun, and entered w/o consent. How is this not a violation of my fourth amendment rights? How can I fight it in court.

Fight what? You haven't said you were charged with anything. If it is for some form of contraband, possession, or weapons charge, yes, your attorney can always file a search and seizure motion if necessary and appropriate.
