Legal Question in Criminal Law in California

Disturbing the peace

I was arrested for disturbing the peace when i accidently tripped over someone and they started trying to fight me, I said i didnt want any problems i dont want to get into trouble. As this happend I turned away was tackled by police officers taken to the ground and immediately hand cuffed. They charged me for disturbing the peace and challenging to fight. The other guy ran away and they didnt catch him. I feel extremely disrespected and wrongfully arrested for only verbally self-defending myself and not trying to get into trouble by taking any further actions. Please let me know what I should do because I am very upset regarding these circumstances. I can understand the officers may not have seen exactly what happend however they never asked me what happend and automatically assumed that since I was speaking back to the guy that I was trying to challenge when I was only apologizing for tripping on him and was explaining that I didnt wan't any problems and I was sorry.

Re: Disturbing the peace

The answer to your un-asked question is: get an attorney and defend against the criminal charges. Feel free to contact me if serious about doing so. If you have any evidence to back up your story, you have a defense.

Re: Disturbing the peace

Pray the DA won't file charges and the case will become a "DA Reject" (this happens a lot). You probably signed a promise to appear, and you'll find out on your court date whether there are any formal charges. (If this happened in Seal Beach the case will be in Westminster.) You'll want to bring a criminal defense lawyer along. The police report will be made available to your lawyer at your first court appearance, called the "arraignment." Don't speak to anybody about the case, especially the police, DA, or judge, without an attorney present.

Depending on the circumstances of the case you could be facing the possibility of a fine, jail time, probation, and/or a criminal record that could keep you from working.
