Legal Question in Criminal Law in California

A doctor pled guilty in a health care fraud.

Heis facing a statutory maximum of 10 years in a federal prison. He had a heart attack 10 years ago only once .on a blood thinner.Can the judge setence him for home detention instead of term jail in federal prison.

Could, but won't. Prison is where convicted felons go; they can get medical treatment when necessary from the prison doctor. That's the consequence of criminal behavior and conviction.

Many federal inmates have serious health problems, for which they receive treatment behind bars. They are not allowed to avoid prison simply because they are ill.

The sentencing judge may decide that this doctor's illness makes a shorter prison term appropriate, but it's very unlikely that someone convicted of such a serious offense would avoid prison altogether on these grounds.
