Legal Question in Criminal Law in California

domestic violence hit and run

my boyfriend was hitting me and when i tired to leave the parking area the gates were locked, he threw things at my car i turned my car around in order to go to the second gate, but my boy friend was in my path and he was hit with my car. he went to icu and had a collasped lung. he threatened my life several times before i even got into my car. i meet with a detective but he is turning it over to the DA. i am curious as to what might happen to me. I also provided the detective with pictures of black eyes and numerous bruises i had endured from this guy before. i have never reported him. he is not pressing charges either. please advise

You might (or might not) be charged with a crime which could be as severe as attempted murder. Recommend you do NOT make any more statements, or answer any more questions, or provide any more materials to the police or DA's office before consulting with an attorney. I hope you kept copies of the materials you provided to the detective.

It's hard to say whether you might face charges based upon the limited information you have provided. The risk is very real, however, and you need to get a lawyer ASAP. Talking to the detective without a lawyer was a *big* mistake, and you could make more such mistakes unless you have an attorney protecting your interests.

Good luck.

Curious?? I should hope so. How about being criminally charged with assault, battery, assault with a deadly weapon, attempted murder, etc, etc. Also, how about being sued in civil court for all the above for his damages and expenses. Your defense is the situation and background you described, but you should not assume they will believe you and your story - he will certainly tell it differently from his perspective [i.e., lie]. You should never have spoken to the police or investigators. SHUT UP and get counsel immediately to protect yourself and try to steer the police and DA away from filing charges, and represent you if they do. Feel free to contact me if interested.
