Legal Question in Criminal Law in California
Domestic violence
A warrant for my arrest has been issued for domestic violence that occured a party I attended new years night. I was confronted by someone who grabbed and threatened me, I tried to avoid a fight but I was then grabbed by a bunch of his friends and dragged out only to be beatin in the front yard. I was hit in the head with a glass bottle mutlipul times and they only stopped when the cops showed up. They are claiming they asked me to leave and I didn't because I had personal belongings in the house I wanted to obtain. I went to the hospital that night and nobody had any injuries. But they are pressing charges and I'm not sure how it might turn out. This is my first time being accussed of a violent crime

Re: Domestic violence
You haven't asked the right question: what do you do?
Exercise your 5th Amendment right to SHUT UP and say nothing to authorities, and hire an attorney to help minimize the damage you are going to suffer. If you have defenses and facts and evidence to help you, the attorney will be able to use them in your defense. If this is in SoCAL, feel free to contact me if serious about doing so.
Re: Domestic violence
There is only one advice that can be given in your situation - hire a good lawyer. Your pleas of innocence and unfairness will not do you any good unless an attorney can investigate and use all the facts to skillfully defend your case.
You do not want a domestic violence conviction on your record if you can avoid it.
Feel free to contact my office if you want additional non-binding consultation.

Re: Domestic violence
You may be able to assert self defense. First, you need to deal with the warrant, though. You don't necessarily have to remand yourself to custody and there is a good chance that if you appear with an attorney, you could be released on your own recognizance OR they might set your bail lower than usual making it easier to get out.
You need help. Contact us if you are serious about getting it.
Good Luck.

Re: Domestic violence
This is probably the answer you expected: You need to get a lawyer. Do not speak to the police, not one word, except to ask for a lawyer. The lawyer you retain will attempt to negotiate for your release on your own recognizance, otherwise you might have to post bail or purchase a bail bond. Remember an arrest warrant can be served at any time and might well result in the cops pounding on your door at 5 A.M. to arrest you. Be sure there is no contraband in your house or car. You need to fight this, or else you could have a criminal record or even get jail time. Recommend you NOT use the public defender unless you want to plead guilty. Please feel free to call anytime to discuss.
