Legal Question in Criminal Law in California
drug possesion warrant
i was arrested in 1996 for a drug possesion intent to sell charge. the drugs for sell were not mine but i claimed them, even though it was obvious they weren't mine.I did have personal drugs on me a small amount. the owner of the drugs did the time, but i still have the charge on me and i am thinking of going to the police station tomorrow to clear things up. I have no prior convictions and or arrest. I am 47 yrs old now, do not do drugs have held the same job for over 7 years, what are my chances of going to jail on this charge and doing time? Im pretty sure they will arrest me and hold me over night for court am I right...? I am pretty worried due to the fact that I dont want to lose my job and I have 6 grandkids now, plus I dont want to do time I was stupid and high at the time, but now Im just stupid... Can you give me advice.. ty

Re: drug possesion warrant
You go to the police station, I guarantee you they are going to arrest you on the outstanding warrant, and take you to court. Your FAR BETTER plan is to hire counsel to go to court and work out the situation for you, so they don't immediately take you in. Feel free to contact me if serious about doing this right. It depends on the facts and circumstances and defenses what your outcome will be.

Do not go to the police station tomorrow. There are much better ways to clear this matter up that won't result in your going to jail immediately. You need to get a lawyer. But an attorney will need to know much more information than you have given us here. I recommend that you have a meeting with a criminal lawyer to discuss your options. Most criminal lawyers give free consultations. I would be happy to meet with you and talk about your situation. If you'd like to do that, feel free to contact me and we can arrange a time to meet. Best of luck and happy new year. Steve Mandell
Re: drug possesion warrant
Jast as in the previous post, and assuming your reference is to an old warrant, you must only act through counsel. It would appear to be a felony warrant?
The police only have one choice and that is to arrest you, set the bail and remand you to custody..where you remain until you post bail or see a Judge who will release you O/R.
I cannot offer any further on prospects as I do not know any facts of the case...obtain counsel and go through the facts with counsel.
