Legal Question in Criminal Law in California

Drunk in public

Hi,

I was just recently convicted of Drunk in Public. So here's the story, the date is 8/1/07, my 18th birthday, I decided that I would go to the club for a night out with the boys. So everything is good except one of my friends had to much to drink. He was very intoxicated and his parents wanted him home so I thought I would help his parents out. Before the club I had a few beers so my friend John, who did not drink, decided that we would drive my drunk friend home first then me. Well long story short, we dropped my drunk friend off at the wrong house becuase he said it was where he lived. So the door opens up and a person that looks like his dad opens the door and takes my drunk friend in. We thought it was his dad so we left. Then about 2 minutes later I had just realized that wasn't his house and some randomn guy had my friend, doing who knows what! So I have John turn around the car and drive back. I approach the house until 3 police vehicles come from behind and point the spot light on me. I immediately tell them the situation and ask them to get my friend out of the house! After all is said, I am breathalized and over the legal limit! I am then taken to jail on my 18th birthdate!!! IS THIS CASE WORTH FIGHTING? HELP!

Re: Drunk in public

You said you were convicted. That means the fight is over. If you meant 'arrested', then get an attorney to defend if you want to fight it.

Re: Drunk in public

If you were already convicted, why are you asking whether the case is worth fighting? I hope you didn't plead guilty, because any competent attorney probably could have beaten the charge on the facts you gave. But the case is over, and you lost, and now you have a misdemeanor conviction on your record.
