Legal Question in Criminal Law in California
Dui felony
My husband went to prison for a third dui, he got a felony, did 9 months in prison, got out on parol for a year, now he wants to drop that felony in to a misdeaminor, can he do that? And if he can, what's the process?

Without trying to offend, what makes him think he gets to 'drop' charges just because he wants to? His record is forever. Expungement is available to many convictions, except for DUIs and except for those with prison sentences. Sorry, but he does not qualify, and his record stands.
