Thank you for your posting on LawGuru.com, and the opportunity for me to help you by responding to your posting.

The answer to your question is difficult, as it depends on the judge you are sent to and his or her personality and how they view warrants. Some judges see allowing a case to go to warrant a lack of personal responsibility, and may punish you by taking you into custody until you can post bail and get out. Other judges will appreciate that you hired an attorney to take care of the case (which by itself shows responsibility), and knows that an attorney can handle the entire case once assigned, without having to worry about you in particular. Still other judges may see you showing up as being responsible, and will allow you to recall the warrant.

It's possible, depending on the age of the case, that you will be ordered back on a later date to discuss your sentence or other options in your case.

I hope this helps. If you do have other questions, feel that you need legal representation, or want legal advice, please feel free to email me directly at [email protected]. It's my pleasure to help in any way that I can. Thank you.

Re: Dui Warrant

If you are charged with domestic abuse, you face potential jail time, so contact the PD if you can't afford private counsel. It is a safe bet that if you go to court on your own, they'll take you into custody and make you bail out, then set the normal court hearings for you to come back and handle like you were supposed to. Contact me if you want to hire private counsel and this is in SoCal.

Re: Dui Warrant

You should contact an attorney either private counsel or public attorney. You need to take action quickly to get the case back in court and have the warrant withdrawn. If you do nothing you will be arrested at some time in the future. The court will definitely want you held in custody until you appear in court. Going to court on your own will reduce the possibility of your being incarcerated. It is not clear how you were involved in a domestic violence incident. If you were the victim the court will generally be more lenient with you. If you are the perpetrator then you are much more likely to put you in jail. If possible before going to court you should arrange for the care of your baby.
