Legal Question in Criminal Law in California

education code and misdemeanor convictions

I was a previous employee for a private tutoring company and also worked in the Anaheim City School District. A bad situation with my ex husband permitted me to have a misdeamor(I was physically abused when pregnant and ended up breaking his car window on purpose) and so I have a misdeamor vandalism charge. Can I still work for the K-12 schools if it is expunged? I have a Masters degree and was wondering if I can work with adults at the college instead? Would I be eligible to apply for a teaching credential?

Expungement is a good thing, but it doesn't necessarily wipe it completely off your record. It must be disclosed to certain licensing agencies and governmental positions. There are things you can do to help, though.

Feel free to call my office tomorrow and we can set up a time to discuss this if you'd like.

The conviction will not necessarily prevent you from getting the jobs you are describing. However, you will need to disclose them. It is good that you have expunged the conviction but you will still have some explaining to do.

The Credentials Board will scrutinize the circumstances of your offense in great detail. The key will be in presenting you and the facts surrounding your offense in the best possible light. You should consider hiring a lawyer who is familiar with professional license issues.

Whether you can work there, or elsewhere, depends upon their rules and decisions, because expunged records MUST be fully disclosed on any application for licensing, certificates, bonding, etc. Plus, depending upon the charges, you may not be able to expunge a DV conviction. If you're serious about trying, feel free to contact me for legal help with expungement or dealing with your licensing agency and employer.
