embezzelment

my friend was released from his previous job due to embezzeling 10k, he was suspended the same night it was taken so he admitted to it the next morning and was made to write a statement, he wrote he felt his mother needed the money and didnt felt it was something wrong at the time. they accepted this and said he will not be charged but is now taken in by the local police department, his bail is $28,500.

Your friend needs a lawyer to get him out without bail (O.R.). He also needs to hire a lawyer to advise him during the rest of the criminal process. He needs representation NOW. Good luck.

Embezzlement is generally defined as the fraudulent conversion of property of another by a person in lawful possession of that property. Crimes of this nature generally have involved a relationship of trust and confidence.

Based on what you have stated your friend may have commited the acts. Whether your friend is prosecuted is at the discretion of the person or entity that your friend took the money from. It could be the insurance company, the actual business or rightful owner of the money.

He should have gotten an attorney to do his talking with the authorities and company. It would have kept him from making the mistakes so far. 'Better late than never' applies here.
