Legal Question in Criminal Law in California
Embezzlement
If convicted of one (1) count of felony embezzlement in the amount of $400,000 what is the sentencing structure and where would time of incarceration be served. This would be the second felony conviction of embezzlement, the first happened in 1999, also in the State of California.

Re: Embezzlement
If convicted, the prison time could be considerable. As others have mentioned you should consult and retain private counsel if you can afford to do so.
Re: Embezzlement
Ask your attorney or the judge, that's the only place your answer is going to come from.
Re: Embezzlement
Obviously, anybody who needs to ask this question needs to retain private legal counsel without delay. The consequences depend on whether it's state or federal court, but my best guess is we're talking decades not years if convicted.
