Embezzlement

My employer has pressed charges against me for embezzlement an i still entittled to my last paychecks?

The answer to your question, of course, depends on whether or not you embezzled. If you did, you have a legal obligation to pay back the money, less any salary earned during your employment.

Technically yes; you could file a claim with the Labor Commissioner. But, you need good criminal defense more than you need to fight about the paycheck. Contact me if interested in defending yourself.

California Labor law provides that you must be paid at the statutorily prescribed times. This must be done even if the employer claims that the employee owes money to the employer, absent an agreement to deduct or a court order to withhold.

Getting a criminal attorney to assist in defending against the potential criminal charges should be a high propriety for you.
