Legal Question in Criminal Law in California
embezzlement
Is an unsuspecting spouse responsible for embezzlement repayment? Spouse embezzled money two times. $165,000. in 1998, $32,000.00 in 2000. This took place in Santa Barbara County. Who pays attorney fees? Who is responsible for taxes on the ''stolen money'' Wife not convicted the first time. Borrowed money from her parents to repay debt to avoid jail. Nothing in writing to her parents. Separated after 2nd embezzlement, she quitclaimed home to me, I took a second to repay her criminal activity.$32,000.00! Now, 4 yrs later, court order to sell house, divorce still pending, been separated since 2001. Proceeds from sale of home in Trust fund, untouchable. Why am I responsible and why is this divorce taking sooo long. I have hired two different attorneys, still no court date, yet I pay her alimony and child support. Why should I be penalized for her criminal activities? And why hasn't the judge ordered her to get a job! I knew absolutly nothing, she handled all finances from the day we were married. Very complicated.

Re: embezzlement
You need a good dissolution attorney, and maybe others. No one can offer worthwhile advice on these serious problems without full review of the facts. Find one local to you to avoid paying excess travel time. Contact friends for referral, or the local Lawyre Referral Service for a name. Talk to several before deciding.
