Legal Question in Criminal Law in California

espunging a felony

Do you have to go to court to request a felony conviction be espunged? Can you submit the paperwork if you live in LA but the crime happened in San Diego over 10 years ago? Thank you.

Some felonies can be first reduced to misdemeanor and then expunged; not available if prison time was ordered or served, not on some violence or domestic abuse charges. Depending upon the court, it may require an appearance, but generally is handled on the pleadings. I handle these frequently, contact me to discuss facts and costs if you qualify.

Where to file depends on your request...a PC1203.4 and/if applicable...a 17b to reduce the matter to a felony must be filed in the rendering Court. A certificate of rehabilitation and petition for a Governors pardon is filed in your county of residence.

Not all felonies may be expunged, however, there may be other options. It requires a filing and a hearing. You or your attorney may file and appear on your behalf. For a free consultation contact me directly.
