Legal Question in Criminal Law in California

This is what i got as to the evidnce against my son, can anybody give me their onpion as to how mutch evidence is really here as for a conviction or other choices we have?

This is from the principal of alt. ed. school DRH for my son

48900 c possession of marijuana resin/hash oil

Here are the summary of events reported to me by Mr. one, transition teacher.

Mr one had just finished serving lunch, and as he looked out side the lunch room, he noticed students standing around Mike.Mike was showing them something he had in his hand. Mr one walked outside towards Mike and the group.Once Mike saw Mr one, Mike began to walk away from the group.Mr one observed that in a last ditch effort not to get caught,Mike placed what he was carrying in another students hand.That student looked at Mr. one, and immediately turned what Mike had given him over to the teacher.Closer inspection revealed it was a small plastic clear vile.inside of it a dark substance. Mr one opened the vile and noticed a marijuana like smell.It was at this point that Mr one called me,and placed Mike on the bench outside of the class room.I spoke to a remorseful Mike who shared a similar story of events.Mike added that the vile, with hash oil had been given to him by another student, and that Mike needed to come up with 10 dollars at a later time.The student in question was searched and nothing found.When questioned the student completely denied ever giving mike a vile or anything else for that matter.

Why do you not feel there is positive and complete evidence that your son possessed the illegal drug? There appears to be no defense.
