California Penal Code 273(5)(a) means that when a person physically injuries someone is either their current spouse, a former spouse or someone with whom the person lived with or used to live with or someone who is simply the parent of a child with the person who physically injuries them then the person who inflicts the harm onto the person who gets physically hurt is guilty of a felony. In other words if you physically hurt someone with whom you are married to or used to be married to, or someone you currently live with or used to live with or someone with whom you have had a child with then you are guilty of a felony. You could face anywhere from 2 to 6 yrs in state prison or you could face up to 12 months in County jail or face a fine of $6,000.00.

Domestic violence/spousal abuse. Could be charged either as misdemeanor or felony. Even if misdemeanor is involved this would be a serious case, especially if there are immigration issues.
