expungement

Please help! I was arrested 4 years ago. I am a nurse and I recently applied for a position and was turned down due to criminal record. (Infarction.) Is there a way to get this expunged I'm in Ca and I am a nurse.

Whether or not you are going to be able to get it expunged depends largely on whether or not you are still on probation for the prior offense. Please contact my office at your earliest convenience so we can determine the status of your case.

There is a form you can fill out and serve on the D.A. and file with the court with a fee of approximately $120 (depending on the court). YOu should be able to get it expunged pretty quickly.

If it was an 'infraction', there is no expungment possible, nor is there for some categories of misdemeanors and felonies. If it was a misdemeanor or felony that can be expunged, even if you can get it expunged, it probably won't make any difference for your stated purpose. Nurses and other professionals must disclose any convictions and expungments on licensing and job applications. Failure to do so is guaranteed termination for perjury and resume fraud when the employer finds out - and they will find it out when they do their required background check. If you disclose it, then it is up to the employer whether to disqualify you because of the conviction, not all convictions will be disqualifying.

You should get it expunged, if possible, so you can say 'no' on other job applications and things like lease and loan applications.
