Expungement!

i was convicted of petty theft last december (2003). The court ordered me to pay a fine for the crime. I just finished paying taht fine last month. I was wondering when is the soonest i can get my case expunged, or at least put a motion in for it to be. And also, do i need an attorney to get my case expunged? if i do, how much would it cost for an attorney to put in a motion for me? i have not been arrested or anything since that incident, and that is the only incident i have ever been arrested for, adn the only thing on my record. so i jsut really need to know when i can do this, and ultimately how much it would cost me. thanks

Thank you for your inquiry. Part of your answer depends on how long your probationary period was, but note that �1203.3 of the Penal Code allows you to apply to terminate probation after a minimum of one year.

After probation has ended, either by early termination, or by expiration of the time period given to you, you can apply for an expungement.

As far as prices, different attorneys may charge a different fee based upon experience, the location of the court where this is pending, etc. You may want to call or email individual law firms to get a quote so you'll know how much the process will cost.

When you have completed all terms of probation, usually three years informal, you can apply for expungement. Usually that is done through counsel, and while prices vary a little, it is not by much.

You could apply for early termination of probation, but it is unlikely to be granted until at least half the term of probation is completed.
