Legal Question in Criminal Law in California

expungement of criminal conviction record

Once a criminal conviction record is expunged, in this case a misdemeanor DUI that is over 30 years old, does the criminal conviction become null and void? Under oath, if asked, can I state I have never been convicted of a crime.

Re: expungement of criminal conviction record

DUI's generally can't be expunged in CA. Convictions that are expunged allow you to say 'no' to conviction on most private employment applications. You still must disclose the conviction and expungement on any application for professional licensing, employment in the education, medical, elder care, child care industries, and for bonding, clearances, govt positions, and many others.
