Legal Question in Criminal Law in California

Expungement

Is it possible to have a misdemeanor expunged before the terms of probation are complete. I have completed 2 yrs of a 3yr summary probation, and I am finding a hard time getting a job due to ''lack of public trust''. Is it possible to have the DA or the judge end probation so that I may have this expunged.

thanx

Re: Expungement

Thank you for your posting.

Technically, your probation has to end before you can apply an expungement. What persons in your situation do to end probation is to file a "Motion to Terminate Probation", (allowed under Penal Code 1203.3), which requires you to pay all fines and complete all terms of probation. Once that motion is granted, an expungement motion is allowed and you are free to expunge your prior conviction.

I hope that this information helps, but if you want more information, have further questions, or feel that you need legal representation, please feel free to email me directly at [email protected]. It's my pleasure to assist you in any way that I can.

Re: Expungement

you can go to court, appear before a judge and request that your probation be terminated early. your chances are probably better with an attorney
