Legal Question in Criminal Law in California

Expungements

My husband was recently told by our child's school district that he could not attend a week long field trip as a ''cabin father'' because his fingerprinting showed his conviction for felony dui and evasion from 15 years ago. He was told by the district that he could have this expunged from his record so he could attend other school trips in the future. Is this true and if so, how do we go about doing this? We live in Sacramento County, but his conviction was in Stanislaus County. Please help!

Thank you

Re: Expungements

Contact the Sacramento County Probation Department and request a form to expunge his record. Fill out the request, and submit it to the probation department with the required fee. In about 90 days he should receive notice that the court has granted his request. If there is a problem then he should consider retaining an attorney to represent him in this matter.

Re: Expungements

Convictions are expungeable, at the discretion of the court, upon a proper application and motion. If he has had no further criminal charges since then, contact me to discuss the facts and fees for doing so.

Re: Expungements

if your husband has a "clean record" since his criminal felony at issue occuring 15 years ago, he absolutely should seek getting the felony reduced to a misdemeanor and/or expunged from his record in its entirety. typically, the expungement process is court discretionary and requires filing and application and motion to start and complete. its a fairly straightforward process, and from the facts given so far, your husband should be able to efficiently and effectively accomplish this. if you would like further affordable legal assistance in this matter, contact us directly with how swiftly you would like to proceed and complete this process.
