Legal Question in Criminal Law in California

Expunging Record and Employment

I am seeking to expunge my record. The offense occurred in San Fernando Los Angeles but I have recently moved to San Francisco. I am on a bit of a budget so cost is a concern. A few Questions I have are

1. I recently missed out on a job because of the offense on my record, how will this affect the livescan fingerpinting results?

2. How long will it take to get my record expunged

3. Since I live in San Francisco can this be done completely by an attourney or must I be present at some point?

An expungement can be done by an attorney without your having to appear. The process takes a few months. If you wish to have any more specific information, please call Michael Bialys of this office at (800) 313-9619

Not all crimes can be expunged, and you have not offered any information about your conviction. There is no way an attorney can assess your prospects without more information.

Re: Expunging Record and Employment

Your record can be expunged rather easily depending on certain circumstances. Questions that must be answered first are: was it a felony?, did you do any prison time?, are you off probation?

These questions must be answered first. If the answer to the first 2 are negative (no) and you are off probation, we can expunge your record for under $600 and you will never have to leave S.F.

However, I must warn you that it is still the judges call as to whether your record will truly be expunged and, if the right search is run by an employer, he/she will find the expungement.

Still, it is better to have it expunged than to let this problem remain. If you would like to talk about this in greater detail, call either Greg Rizio (my law partner) or myself at toll free 1-888-292-8888.

Re: Expunging Record and Employment

Contact the probatio department in the county in which the conviction occurred and request their form for expungement. Then fill out the form and submit the form with the required fee. If the convictions can be expunged then it will be done. The cost is less than $100. If that fails then you can discuss the matter with an attorney. and then determine the best approach.

Re: Expunging Record and Employment

Expungement will allow you to say 'no' to convictions on most job applications, but not to goverment and security screening applications, professional credential applications, etc. It can be done 'long distance' by you and your attorney. Contact me if still interested.
