Expunging a Record

I have moved to Santa Barbara from Los Angeles. My court case was handled in San Fernando. I have fully completed my sentence and wish to get my record expunged. As my finances are tight I was wondering how much this will cost to do, if it can be done through mail and fax and what expunging my record will do for me. I am a chef and sometimes have to be fingerprinted for a background check when applying for a job. What will expunging my record do when someone looks at my background?

Whether you can get a conviction expunged depends on a variety of issues. Actually, 'expunged' and 'dismissed under Penal Code Section 1203.4' commonly get confused. To expunge a conviction is to show that there were not facts sufficient to get the conviction. This is very difficult and very expensive.

To get a case dismissed under 1203.4 is rather easy. You simply go to the Clerk's office at the court where the conviction took place and ask for their local 1203.4 form. If they don't understand what you want, ask the Public Defender's office where you were convicted.

If you have satisfied your probation for your conviction without any additional convictions or violations, you will most likely get your charges dismissed. This means you will not have to answer 'yes' on most private employment applications when you are asked if you have been convicted. However, you will still have to answer 'yes' for public jobs and some licensing procedures such as C.P.A. or Attorney.

Contact the probation department in the county in which the conviction occurred. Request a form to have the conviction expunged. There is a fee for this service, which is generally quite small.

What will be seen depends on who looks at your record. Law enforcement agencies will still be able to see the conviction. In the past this expungement has been sufficient to satisfy many licnesing agencies.
