Expunging and /or Sealing a record

Im in process of a career change & will need to obtain several state licenses(adjusting licenses). I was arrested in 1996, assigned a PD, advised from PDefender to plead in a certain way, charge was dropped to a misdemeanor, received comm. service & 36mnths probation. Now have a record for poor choice in friends. Never been in trouble with law before or since the incident. Can I expunge and seal my record (arrest, charges, conviction, etc..), so I can move forward in my adjusting career with out problems? And what do I need do (paperwise) to start the process and ultimately obtain my career goals without any problems?

If the conviction was in San Diego you can go on the San Diego Court website and download the misdemeanor expungement packet.

You can hire an attorney to fill out the paperwork and go into court. The attorney will tell the court what is going on and present your situation in a favorable light. The Court will then hopefully grant the request.

Every day I tell people not to plead guilty, and not to uise the public defender, because they will not inform you about the future consequences of a guilty plea. They just want to be rid of you. If you have a conviction for theft or any kind of dishonesty, all the "expungement" in the world won't help you, you will be denied a license, and you'll have trouble getting work wrapping fish. Sorry, but that's how it is.

Yes, you can expunge most convictions, and you should, but you are sadly misinformed about the benefits. You will still be required to fully disclose all convictions and expungements on applications for professional licenses and certificates, bonding and security clearances, health care and child care jobs, among other things. Any conviction that does not include state prison is possibly expugnable. It is always up to a judge to approve the expungement. An expungement is a valuable legal tool, however, it is not a legal white out i.e. if you are in need of a State License you will need to inform the hiring entity of the conviction. While you can you attempt to seek and an expungement yourself, it is recommended you seek legal assistance through a legal resource to assist with the process.
