Exsponging a Felony

I was convicted of my first offense (PC 245.a.1/assault with a deadly weapon) in Feb. 98. I spent 200 days in county and successfully passed an anger management course. After 9/11, it's been difficult to obtain employment. I've been a model citizen since my release. I'm also earning my Associates in Science on my way to a Bachelors so I am protecting my future. I'm wondering who/where I should contact to assist me in exsponging this felony and if so an approximate value of how much it will cost. Any information would be greatly appreciated. Thank you.

I agree with the answers that have been provided by the other attorney's. In California, you have the opportunity to seek relief under P.C Section 1203 and 1203.4. You must file a form with the Court, pay the fee and wait. Usually it takes a few months to hear anything, but an attorney can expedite the process and have it done in as little as a few weeks. Also, you must qualify for relief under the code; you must have successfully completed probation and you cannot have any new charges pending. Feel free to ask more questions.

I will be happy to help it with you. So long as you did no prison time, you MAY be able to get this expunged, however the process is not as easy or assured as doing it on a misdemeanor without time served. Contact me to discuss.

Contact the probation department in the county in which this occurred and ask about having the conviction expunged. The fee is usually less than $100. Should this prove to be unsuccessful then contact an attorney.
