Legal Question in Criminal Law in California
Extradition from California to Michigan
My brother was picked up my the US Marshall's outside of my Mothers house earlier this week. It appears there is a pending warrant in MI for 1st degree sexual assault charge from 1998. My brother has been to prison (for 3 yrs) about 5 year ago. Why did they not take him then? He has an identity hearing here in California today. What are the chances of Michigan coming to extradite him back, for charges 20 years old? He never was arrested or tried for the charges on the warrant.

All your question could only be answered by his attorney, or by the prosecutor at the hearing. None of us out here know anything about the case to be able to give opinion. In general, other states usual extradite on serious felonies, but this is so old they may not. No guarantees.
