Legal Question in Criminal Law in California
My name has been Falsely forged
what can i do to clear my name from this record in court if my name was falsely forged and i have reason to believe my sister was the one who did the forging? this ticket has already turned into a warrant for failure to appear i had never received any notification of a ticket and i did not know this ticket was in my name until 11/29/2008,this happened on 5/6/2008. I have never been in trouble with law or have any bad records. what can i do ? I'm afraid to go talk to a judge because i don't want to go to jail for something i never did. The only real proof is my word that i didn't sign and that the signature on the ticket is not mines,and the address that was given was not my address i don't know the address and never lived at that address.

If you're unwilling to go to court by yourself, then you'll have to hire an attorney to represent you. IF you can prove the signature is not yours, then the case against you would be dismissed. You could hire a handwriting expert to examine and testify about the writing. If you can't prove the signature forged, then your attorney can negotiate a 'deal' on the charges. If this is simply a traffic ticket, the court would likely not impose jail, but merely a substantial fine on the warrant and ticket. If serious about hiring counsel, feel free to contact me.

You do not talk to the judge - you talk to your lawyer. If you cannot afford private counsel, a public defender will be assigned to your case.
I would hire a private lawyer to first deal with the warrant issue. If the notice was simply mailed to you and you never received it, this should not be a big problem. The rest is up to you and your lawyer. If you do not want or cannot afford a private lawyer, contact the Public Defender's office at the courthouse where the warrant was issued.
