Legal Question in Criminal Law in California

Falsley accused

My brother was convicted of a crime years ago which was molesting his nephew. He was interrogated and eventually admitted guilt because of the tactics used by the detective. His alleged victim to this day denies that anything ever happen. The victim was about 6 years of age at the time he is now 22.My brothers life has been ruined because of this he has been repeatedly violated being on parole, has made several suicide attempts was even raped in the california youth authority. He is not completely innocent but the crime of sex offence against his nephew is not something he did how can he be cleared and receive compensation for all he suffered? I should add we filed a civil complaint against the police dept back in 1990 when the case began because of the way the detective interrogated him. My brother is emotionally immature. He is now on psych meds I beleive due to all of this.

The age of this matter makes it extremely difficult if not impossible to do anything about it at this stage. It is safe to say that you can pretty much forget about any civil lawsuit. Vacating your brother's conviction might be possible but the necessary first step would be a thorough review of all the facts by a competent appellate attorney.

And your question is?

Any claims he may, or may not, have had are now long since barred by statute of limitations. He now just gets on with his life.
