Legal Question in Criminal Law in California

Felony Conviction and Probation Violation

I have a Probation Violation for felony conviction, CA Vehicle Code 2800.2, Evasion of Peace Officer. I drove to the police station from a remote area because a girl in grad school was killed by a highway patrolman. How may I get my probation reinstated? I am in my home state on an interstate compact between CA and home. My probation officer here gave me a good report. The P.O. in CA whom I've never met gave me a horrible report and recommended that I be locked up in state prison for 3 years. How can I fight this? What is the maximum amount of incarceration time? How may I seek an acquittal, dismissal, appeal, overturn, suspension, etc., of this P.V. or of the original charge? Is bail ever offered on a probation revocation? How can I get more time on this so I do not lose my job? Wouldn't it be more likely if the judge was going to reinstate me to tell my attorney (on a 977) that and let me continue on probation here? If the judge wants me out there for sentencing, does that imply he is going to revoke me? May I get a guarantee of either reinstatement or revocation (including total incarceration time) from the DA and judge before going out there? Any advice in general?

Re: Felony Conviction and Probation Violation

The only advice anyone can give you is to hire a CA attorney to help you, unless you want to come pro per to CA for court yourself and take your chances. With competent counsel, your good local report should be used to continue your probation. Call if interested in discussing. 714-960-7584
