Legal Question in Criminal Law in California

Felony that needs to be expunged or pardoned

A year ago my boyfriend was drunk and called his friend to come pick him up. His friend came to pick him up in a ''hot car'' and the cops pulled them over. My boyfriend had to idea that the car was stolen but was charged with receiving a stolen vehicle. He did like 62 days in jail and now on probation. Now he is having a very hard time getting a job. What can we do to get this conviction taken care of?

Taken care of? That should have been handled in the original defense. Now, once he successfully completes all terms of his probation, and if he has no further arrests, he can try to get it expunged. IF successful at that, he would get to say 'no' to conviction questions on private employment applications. Have him contact me if serious about getting this done.

Get it reduced to a misdemeanor and then get it expunged as soon as probation ends.

The time to seek legal help was before he went to trial. If the conviction was recent (and his 62 days in jail began before he was convicted) he may still have time to appeal, though nothing you have said suggests his appeal would be likely to succeed. He may also be able to attack his conviction via habeas corpus, but here again I can't say whether he has any good arguments for such a petition. The other option is to have the conviction expunged as Ms. Healy suggests. Your boyfriend will have to finish his probation before he can seek an expungement.
