felony probation

I was convicted of 2 felony child stealing in 2000, I paid all my probation fines, and was reduced to sending in a form once a month. I never finished sending in my forms, and started a new career, I was very relieved when my back ground check turned out ok, they new about my arrest, but everything else was good. Now in 2008 I was arested for felony probation violation, I am out on bail and have to return to court this week, do you think they might see that i have stayed out of trouble for the past 8 years, and just reinstate my probation. by the way this happened in riverside, ca, I live in la..thanks

I'm not sure what you mean by "child stealing"; did you steal when you were a child, or did you actually steal a child (in other words, were you convicted of kidnapping)? Your chances of leniency will be better in the former scenario than in the latter.

Either way, though, the risk that you will be sent to prison is quite real. You need a lawyer to protect your interests. Start by calling the lawyer or legal office that represented you in 2000 and see whether they will represent you again.

The fact that you were allowed out on bail on probation violation bodes very well for your case. This is a case which could end in simple reinstatement of your probation, based on the facts you provided. Do not try to do it alone, however, as risk of county jail or maybe even state prison exists. Get in touch with your old lawyer or get a new one.
