Legal Question in Criminal Law in California

Right to own Firearm

in 1995 i was charged with 273.5a,17b4, I am trying to get into law enforcment, completed all requirments i.e probation ,fine, no criminal record at all. I have been told different stories in regarding possesing a firearm, ATF says all i need to do is get my case dismissed due to it being a misdemeanor as well as the gun store. Can you please advise. Will a dismissal under PC1203.4 or PC1203.4a restore this right and allow me to enter into law enforcement.

Re: Right to own Firearm

Allowing you to enter law enforcement is at the discretion of the agency involved. Ask them your question directly before investing time and money on education or legal efforts. FYI: Federal and state laws prohibit anyone convicted of domestic violence, or who has ever been subject to a domestic violence restraining order, from possessing a gun or ammo; it is a felony to even touch one. Doing an expungement under 1203 won't change that prohibition. You would have to seek a court's restoration of rights through a proper motion with good cause. However, expungement would be of value to you in applying for private employment, so it is worth seeking.
