Legal Question in Criminal Law in California

Can I own a firearm?

Around a year ago I plead guilty to a charge of carrying a concealed weapon (M12020(a)(4)). I was put on a year of informal probation, and the probation is now done. Am I now able to own/posses a firearm?

Re: Can I own a firearm?

If you plead guilty to a misd. and not a felony (as the punishment indicates) you may own or posses a firearm.

Depends on the conviction. A felony conviction bars you from possessing firearms and ammunition, as do some misdemeanors. Yours is probably a misdemeanor. However, the terms of your probation may [probably] contain a specific provision about this. You need to review them. IF you are barred, you may be able to have your attorney apply to the court for a release from such prohibition, and restoration of your rights, upon a showing of good cause. Feel free to contact me for help in this; one of my specialites is firearms law.

Penal code section 12020(a)(4) can be charged as either a felony or a misdemeanor. If you were charged as a felony, then you would need to file a motion to have it reduced to a misdemeanor pursuant to penal code section 17. Until that is done you have a felony conviction.
