All depends on the evidence against you. If you are innocent as you say you are, and are really a victim, you should have no problems proving your innocence. If the police do not want to realize their mistake, you might want to consider retaining an attorney to intervene prior to any charges being filed.

Clearly you need to defend yourself. Unfortunately overzealous prosecutors often file criminal complaints before considering the facts. The overworked detective is more often then not, going to give the complaining witness, the benefit of the doubt and forward the matter for prosecution. Call me if you get serious about avoiding jail.

"Can they hold me responsible?" -- they are doing so by arresting you, aren't they? Hire a criminal defense attorney to provide the legal help you clearly need.
