Fraud Charge

Have 20 yr old son, has fraud charge under $1K on record. Does it come off when he reaches 21. Out of Ventura CA.

There are two ways to remove a charge.

If the case was dismissed, acquitted or pardoned, you can file a petition to expunge the charge and conviction.

If he received deferred adjudication probation and sucessfully completed it, he could seek an order of non disclosure.

Nothing ever goes away on its own.

NO. Records are forever. However, he could seek expungement, meaning a Petition and motion to the court. If granted, the conviction would be then be set aside and shown as charges 'dismissed' so that he can say 'no' to convictions on most private employment applications.
