Legal Question in Criminal Law in California

My friend let me borrow his car one night and as I headed home , I ran out of gas. The next day I went to pick it up and it was gone he is threatening to bring me to court since it was found rolled later on. Am I legally liable and if so, what strategy should I take in court that will find.me not liable. "Police report already given by me stating I was allowed to borrow the vehicle
