They may or may not, that on all the facts, which are not stated here. The main question is, did they even have a warrant to come in? Feel free to call me with any questions.

CAN the case end up being reduced or dropped? Sure. Is that likely, just because you want it? No. The police and DA don't spend time and money arresting, charging and prosecuting cases only to drop them without a fight, and a reason to do so. They will be happy to prosecute everyone there with various conspiracy and possession theories. They will be delighted to get a confession from your friend.

Of course you can fight the charges. When arrested or charged with any crime, the proper questions are, can any evidence obtained in a test, search or confession be used against you, and can you be convicted, and what can you do? Raise all possible defenses with whatever admissible and credible witnesses, evidence, facts and sympathies are available for legal arguments, for evidence suppression or other motions, or at trial. If you don't know how to do these things effectively against an experienced prosecutor intending to convict, then hire an attorney that does, who will try to get a dismissal, diversion program, reduction or other decent outcome through plea bargain, or take it to trial if appropriate.

If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. Ill be happy to help you, using whatever defenses there may be.

They can charge more than one person with possessing the same items, so can they charge you even though your friend took the blame? Yes. Can they prove it? That depends on all the facts.

You may have search issues where you may be able to suppress the evidence if the search was illegal. You'll need to discuss it with your attorney.
