Legal Question in Criminal Law in California
My girlfriend and I are accused of grand theft. If she were to tell her lawyer that she will testify against me for exhoneration of charges against her and the D.A. agrees.
Does she sign a contract to this with the D.A.?
If so, If after the agreement is signed, I were to pass away (die), prior to trial, would she still be granted exhoneration per written agreement.

I hope you are not thinking of killing yourself. It can't be that bad. Lots of people survive criminal convictions, including some high ranking police officers, and go on to have worthwhile lives and careers. But to answer your question, I did such a deal and explicitly put in the written agreement (yes, it is put in writing) that should the testimony of the informant for any reason not be needed after the contract is signed, he still gets all the benefits of the deal.
Sounds like a loony suicide pact to me, but IF she gets such a 'deal', yes it would be honored.
