grand theft auto

my brother is being charged with grand theft auto of my mothers car. can the state charge him with grand theft auto if my mom isnt pressing charges against him? if they cant press charges can they plea his evading cops charge to a misdemeanor

The state can charge your brother whether your mom wants him charged or not.
