Grand Theft

My brother was recently arrested by LAPD on grand theft charges stemming from him using his work expense account to make unauthorized purchases totally just over $20,000. He has no priors, what are the chances he will get jailtime? He is out on bail right now, also does it make a difference that he was arrested as a fugitive? There was a warrant out for his arrest, but he was not aware of it therefore he was brought in as a fugitive.

Arrest warrants do not require prior notice or warning otherwise people would evade arrest. Given he has no priors subject to reviewing his file and barring other circumstances e.g. resisting the arrest, I can probably get him a acceptable disposition.

If he can convince the judge and the DA that he was honestly unaware of the arrest warrant, his fugitive status should not matter. Assuming he cannot beat the case, i.e., he does not have a triable case where he can realistically expect to prevail at trial, he should be eligible for probation given his clean record. However, probation often comes with significant amount of county jail time (as opposed to state prison). No jail time resolution is possible and would depend on a number of factors (nature and wishes of the victim, his background and character, the particular courthouse/DA, etc.), the most important perhaps being whether and how fast he can come up with the restitution to pay the victim back.
