Grand theft? California

My money - six figures - mistakenly ends up in X's bank account. X admits not his, will return. But does not after reasonable period of time. Is X now guilty of grand theft in California and will the police/prosecutor actually do anything?

If X didn't take the money then he hasn't committed grand theft. He has to give the money back to you, but my sense is that he hasn't committed any crime and that this is a civil case.

Depending upon how the money was "mistakenly" put into the wrong account you may be able to void the transfer and get the funds back that way, but you may already have waited too long to do this.
