can my son be charged with a gun charge and fire a weapon with out the gun and also no gsr testing was done but there is video that shows him with a gun or somthing that looks like a gun but video is not a very good quality

Of course your son can get charged. People get charged with scant or tenuous evidence all the time. Charges rarely disappear on their own. Your son needs a lawyer as firearms related charges can have serious consequences.

Can he be? Of course. It's then up to him to defend against the charges, just like any other criminal case. Get him an attorney.
