Legal Question in Criminal Law in California
Harassment
I have been receiving harassing letters via the mail from a woman. They are increasing in verbal abuse with each letter. I receive one about every four days. I am up to 8 letters. Can you obtain a restraining order and how do I prove this. She has a past of violent behavior and numerous restraining orders from old boyfriends and husbands.

Re: Harassment
You can file in court to obtain a temporary restraining order, which becomes effective upon serving her with it. Assuming you know where she lives or works, service can be done. Once the temporary order is issued and served, then there is a court hearing to make it permanent. If interested in doing so, contact me to discuss procedure and costs.
Re: Harassment
In order to have a Court issue a restraining order, you need to show that this person is violent towards you, has threatened you with violence, or acts in such a manner that you are scared.
The web address below should offer the proper guidance as to the process for obtaining a restraining order. If you need any assistance, feel free to contact my office.
