Legal Question in Criminal Law in California

Hello,

I got caught stealing at a clothing store today and I ran away, dropping my bags with me at the door. My friend got caught by the police (under petty theft) and the police just called me telling me that I have to go back. Do I have to go back to the department or am I safe? I am 18.5 years old. Also, they have video surveillance of me stealing. The police department just called me to tell me to go back to the department or they will "call the D.A. and get an arrest warrant and go to my house and arrest me". My theory is that they cant accuse of me stealing or anything because I left all my goods outside the house, but I don't have any law experience. Please help to shine some light on this situation. Any help is appreciated.

You already asked this question, and I already answered it. I am trying to help you, but that doesn't mean I'm going to tell you what you want to hear. Please, pretty please, dig the crap out of your ears and listen up. I have much more experience as a lawyer than you have as a thief. Your legal theories don't mean diddly-squat. Your life is about to change immediately, dramatically, and for the worse. Within 24 to 48 hours the police will show up at your house and arrest you, probably at 5 AM. This will greatly upset anyone else living in your home. By now you should have explained to your Mom and Dad that you need to hire a lawyer to keep from going to prison. You will also need a bail bondsperson to get out of jail, but if money is tight and you have a choice, stay in jail and hire the lawyer first. If your parents help you, and you do get a lawyer, it is still possible that you could be charged only with stealing and not also with robbery and/or burglary (these are -felonies- punishable by state prison). You must not go to the police station, and you must not say anything to any police officer except "I have nothing to say to you without my lawyer being present." Go to the nearest mirror and practice saying this about 30 times. Keep some money on you so that you can buy something in the county jail if you go there. Do not plead guilty or say anything at all (-not one word-) to any police officer. Follow this good advice and you might possibly get out of this without going to prison. Safe? Nice try. Your theory will give the police and DA a good laugh. However, the standard legal advice to you is: exercise your 5th Amendment right to SHUT UP. Hire an attorney and say nothing to anyone but him. Do not return the police calls, let him. If serious about hiring counsel, feel free to contact me.

You should not have any contact at all with the police. The only way you can contact them is through an attorney. If they already have enough evidence to arrest you, then they will. Giving them any more information in the form of a statement will only hurt you. Many times having an attorney contact them may help you down the line but it needs to be done asap. Don't speak to the police without an attorney. People think they can talk their way out of trouble every time, but it just makes it worse.
