Legal Question in Criminal Law in California

Hello,

My question is what is the name and where can I find the form to summit to the courts to be taken off the PC290.00 list. The offense is 30 years old and there was never a repeat offense and the person involved was told by the ADA that there is petition that can be filled out by the offender and summit to the courts so that he may not have to register anymore. I can not find this form and the person can not afford 9,000$ for a attorney to do it for him

Under some circumstances, you can get your name removed from the Megan's Law Internet site, but you can NOT be relieved of your lifetime reporting and registration requirements unless you receive either a certificate of rehabilitation from the court [difficult], or a California Governor's pardon [rare].

You may apply for exclusion from the Megan's Law Internet site if:

a) you have successfully completed probation or are currently on probation;

b) you can submit a certified copy of a probation report, pre-sentencing report, report prepared pursuant to PC 288.1, or other official court document that clearly demonstrates that:

1) You were the victim's parent, stepparent, sibling, or grandparent.

2) The crime did not involve oral copulation or penetration of the victim or the offender.

3) you have never been adjudicated a sexually violent predator pursuant to W& I 6600, et seq.

4) during probation, you did not receive additional incarceration time for a violation or probation, nor were you convicted of another offense resulting in a sentence to county jail or state prison.

If serious about trying to do so, feel free to contact me if you think you qualify. I don't know who told you $9k, that is WAY higher than you should expect to be charged.
