You can talk the police but if you want to sue the driver you are best placing your question on a civil litigation page or a traffic page.
Make sure you file insurance claims and the see a personal injury attorney
You can sue the driver and registered owners. IF they have insurance, you may be able to recover from that policy. If they don't have insurance, and if they have no assets or income for you to recover from, you will not recovery much from them. If you have Uninsured Motorist coverage on your vehicle, or have medical coverage, you can make a claim against YOUR policy. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. Ill be happy to help fight and get the best outcome possible.
