If you are a prosecutor and asking this, I'm more than a little suspicious of your training. If you are the defendant, any answer you get here isn't going to do you any good, since whatever the court and prosecutor order gets done; then your attorney will have to analyze to determine if it provides you any arguments about due process rights violations.
If you don't have counsel in a murder case, you are really not behaving rationally. Contact me if you are serious about hiring counsel, and the case is in SoCal; otherwise apply to the public defender if you can't afford private counsel.
