I was arrested and charged with HS 11379, would I be eligible for drug diversion?

On it's face, no. If it is a transportation charge (not sales) you could get prop 36...diversion would require a reduction in the charge to simple possession.

No. This is a crime of sale/transportation, rather than mere possession. So diversion would not generally be available.

It depends where you are arrested. Some counties (like San Francisco) are much more liberal than others. Also, depends on the facts. In general, California can be very strict in a lot of areas. If you can;t afford a private lawyer, ask your Public Defender. Sorry, I can't be of more help.

You are not elligible for a diversion program. The prosecutor is basically saying you are either a drug dealer, or working for a drug dealer. Only those who appear to be drug users can enter diversion programs. You will need an attorney.
