Legal Question in Criminal Law in California

Husband in jail for civil judgements, but wasn't business owner

Ever heard of this? My husband was an employee of a high performance auto company. There were @ 6-8 people that weren't happy over a course of time, and they got civil judgements in his name and the owner however, the owner filed cpt.7. My husband didn't stress because he isn't the owner. Last year he got arrested by a detective that said he knows he's lying, etc. The DA threw it out. We got raided a month later, they found nothing. Now, 9 months later, they picked him up again with guns to his head in front of our kids,a 1,000,000.00 bail, and this time a DA in our city is entertaining it. The weird thing is, they are saying it's 10 counts of grand theft yet, he never stole a car and the biz wasn't in his name!!! They say they can do that because it's over $400.00 in damages per car. I'm so confused and upset. ALSO, the unit that arrested him is a unit that only handles stolen cars. How could this be his jurisdiction? How does he get away with this? How can he try this case again with a claimant that asked to be dropped in writin all over again, and encourage the claimant to go forward 9 months later, after the man asked to be dismissed? How can he give him a 1,000,000.00 bail so it's impossible to get him out. Help!

Re: Husband in jail for Civil Judgments.

Hello---I am an Attorney member of the LawGuru site. From all of the information you cite, it does seem very strange, and improper. A million dollar bail is reserved for accused persons who the authorities believe have committed murder or some other heinous crime(s). If you have any more info or update, or would like to discuss this, you may email me, or call: (562) 929-7422. It does look like something is really wrong with this kind of over-reaction against a non-business owner. Attorney Woodworth

this is a very complicated case. You need to gather all the paperwork relating to his bank accounts and this business. If you can afford private counsel, contact me or get a file together for the public defendar.

It all sounds so strange because you don't know all of the information that the cops and the prosecutors know. The good news is that your husband's lawyer will get all of the police reports, and s/he will then know what the charges are about, and how to begin the process of defending your husband. You ask how an auto theft detective can arrest your husband. Your hubby works for a high performance AUTOMOBILE shop. They deal with automobiles. The cop investigates people who do bad things with automobiles. Sounds logical to me. And you say your husband isn't stressing about those 6-8 judgments in his name??? Try borrowing money or buying a house. His credit is ruined. He's got much bigger problems than you realize. He needs legal help in a big way. If you want to discuss this more fully, please don't hesitate to call me. Steve Mandell 310 393 0639
